This policy and the Terms are published in English, and English is the version that governs. We do not translate them: a legal text translated without review is not the same text in another language — it is a different promise. Terms of Service — Tabelingo

These Terms of Service ("Terms") govern your access to and use of the Tabelingo mobile application and any related services (together, the "Service"), operated by MVA SERVICOS ONLINE LTDA, a limited liability company incorporated in the Federative Republic of Brazil, enrolled with the Brazilian taxpayer registry under CNPJ 47.195.396/0001-33 ("Tabelingo", "we", "us", or "our"). By downloading, installing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. The Service
Tabelingo reads photographs of restaurant menus, produces machine translations of the dishes, converts prices to the currency of your choice, and assembles orders that can be shown on screen or spoken aloud in Japanese. The Service is a technological ordering aid — it is not a professional, medical, dietary, nutritional, religious or legal service.
2. Not medical, dietary or safety advice
The Service does not provide medical, dietary, nutritional, religious or safety advice.
The Service indicates ingredients that a dish may contain based on general information. It does not verify the actual ingredients used by any particular restaurant on any particular day, and the absence of an allergen indication is not a representation that a dish is free of that allergen or safe for any individual to consume.
Reasons an allergen may not be indicated include, without limitation:
- Japanese law does not require allergen labelling for restaurant meals, and the information may not exist at the restaurant.
- The reading of a menu photograph by machine may be incomplete, inaccurate or uncertain.
- Restaurants vary their recipes. Common ingredients such as dashi (fish stock) frequently appear in Japanese dishes without being declared.
If you have any food allergy, intolerance, religious dietary restriction or medical condition, you must confirm every dish directly with the restaurant before consuming it. The Service provides pre-written questions in Japanese for this purpose. Any use of the Service in connection with such conditions is at your own risk.
Severe allergies. If you have a severe or life-threatening food allergy, we specifically recommend that you do not rely on the Service as a source of allergen information, and instead confirm dish contents directly with the restaurant in every case. On first launch of the Service, you are presented with a dedicated screen requiring you to acknowledge and accept the limitations described in this Section 2 before you can use the Service. Your acceptance of that acknowledgment is recorded with a timestamp and constitutes informed consent to the risks described here.
To the maximum extent permitted by applicable law, you release Tabelingo from any and all claims, liabilities, damages, losses and expenses arising from allergic reactions, intolerances, dietary or religious violations, food-borne illness, or any other adverse effect resulting from food ordered or consumed with the assistance of the Service.
3. Translations, transcriptions and voice output
Translations, transcriptions and spoken output are produced by machine learning systems and may contain errors, omissions or inaccuracies. You are solely responsible for reviewing translated content before presenting or reading it to restaurant staff.
We do not warrant the accuracy, completeness or reliability of any translation, transcription or spoken output. We are not liable for misunderstandings, misordered items, incorrect charges or any other consequence arising from reliance on Service output.
4. Prices and charges
Prices displayed by the Service are extracted from photographs of menus and may be misread, out of date, displayed excluding tax, or otherwise inaccurate. Currency conversion uses exchange rates obtained from a third-party source no more than once per day and is provided as an estimate only.
Japanese restaurants commonly apply charges that are not shown on the menu, including otoshi (compulsory appetiser), table charges and service charges. The Service cannot know any specific restaurant's policy in this regard.
The invoice issued by the restaurant is the sole authoritative amount payable. We are not liable for discrepancies between prices displayed by the Service and amounts actually charged.
5. Your account and email
The Service creates an anonymous session on first launch. You may optionally link an email address to preserve access across devices. You are responsible for maintaining control of that email address and for all activity that occurs under your account.
You may delete your account and associated data at any time from Settings → Delete account. Deletion is immediate and permanent.
6. Plans, purchases and fair use
6.1 Free tier
The Service is available at no charge with a limit of one complete menu reading per calendar month, together with the associated ordering, phrase and currency features. The free allowance resets on the 1st of each calendar month.

Prices are shown in the App Store or Google Play, in the applicable local currency, before you confirm the purchase.
6.3 Cancellation and refunds
Purchases, cancellations, refunds and billing disputes are handled by Apple App Store or Google Play under their respective policies. We do not process payments directly and cannot issue refunds outside those channels.
The Monthly plan renews automatically until you cancel it in your App Store or Google Play account settings. Cancellation stops the next renewal charge; access continues until the end of the paid period.
Statutory withdrawal and refund rights under the law of your country of habitual residence (including Article 49 of the Brazilian Consumer Protection Code and equivalent EU consumer protections) are not affected by this Section.
6.4 Fair-use limits
Paid plans include the following fair-use ceilings on menu readings, which exist to prevent abuse of a service that incurs per-use cost:
- Monthly plan: 100 menu readings per calendar month, resetting on the 1st.
- Lifetime plan: 1,000 menu readings in total (non-resetting).
Upon reaching a ceiling, new menu readings pause. Other features (saved menus, ordering, phrases, currency conversion) remain available.
We may adjust these ceilings from time to time. Reductions will not apply retroactively to purchases already made.
6.5 Definition of "Lifetime"
"Lifetime" refers to the operational lifetime of the Tabelingo Service — not to the natural life of the purchaser or of any device. The Lifetime purchase is a one-time payment with no recurring charge, valid on the store account of purchase, for as long as we continue to operate the Service.
We do not warrant that the Service will remain operational for any minimum period. If we decide to discontinue the Service, we will provide at least 90 days' notice inside the app, during which no further charges will be made.
Beyond providing the notice period described above, we have no obligation to compensate purchasers of the Lifetime plan upon discontinuation of the Service, except to the extent required by mandatory consumer protection law in the purchaser's country of habitual residence.
7. Acceptable use
You may not, and may not permit any third party to:
- use the Service in violation of any applicable law or third-party right;
- redistribute restaurant menus, translations or other Service output commercially, or in a manner that competes with the Service;
- use the output of the Service to train, build or improve any competing product, model or dataset;
- access, tamper with, probe or use non-public areas of the Service or its infrastructure;
- reverse engineer, decompile, disassemble or otherwise attempt to extract the source code of the Service, except to the extent this restriction is prohibited by applicable law;
- use automated means (including bots, crawlers and scrapers) to interact with the Service;
- circumvent, disable or interfere with security features, authentication, rate limits or fair-use ceilings;
- use the Service in any way that could damage, disable, overburden or impair its operation.
We may suspend or terminate your access to the Service, in whole or in part, if we reasonably believe that you have violated these Terms, and without liability to you.
8. Intellectual property
The Service, including its software, user interface, brand and logos, curated dish images, curated ingredient database, translation glossaries and all related content (excluding user-generated content and restaurant menu photographs), is owned by us or our licensors and is protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Service for its intended purpose.
You retain any rights you have in menu photographs you upload. By uploading a photograph, you grant us a limited, worldwide, royalty-free licence to process, store, transmit and use such photograph solely for the purposes described in our Privacy Policy.
9. Availability, changes and third-party dependencies
The Service depends on third-party infrastructure, translation, transcription and payment providers, and on a functioning internet connection. Menu reading is not available offline.
We may modify, suspend, restrict or discontinue features of the Service at any time, with or without notice, to manage cost, address technical issues, respond to legal or regulatory requirements, or improve the Service. For Lifetime plans, Section 6.5 governs full discontinuation of the Service.
We are not liable for unavailability of the Service caused by third-party providers, network conditions, force majeure events, or planned or unplanned maintenance.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security or uninterrupted operation.
Without limiting the foregoing, we do not warrant that:
- translations, transcriptions, allergen indications or dish descriptions are accurate or complete;
- prices or currency conversions are current or correct;
- the Service will meet your requirements or expectations;
- errors, defects or interruptions will be corrected.
Certain jurisdictions do not permit the exclusion of implied warranties. In those jurisdictions, our warranties are limited to the minimum extent required by law.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, business opportunity, goodwill or reputation.
- We are not liable for damages arising from allergic reactions, intolerances, medical conditions, dietary or religious violations, or reliance on translations, transcriptions, prices, allergen indications or spoken output, whether based on contract, tort (including negligence), statute or any other theory.
- Our aggregate liability to you for all claims arising out of or relating to the Service is limited to the greater of (i) the amount you actually paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (ii) the equivalent of USD 50.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our gross negligence or wilful misconduct, and non-waivable rights under the Brazilian Consumer Protection Code, EU consumer protection law, or comparable statutes in your country of habitual residence.
12. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Tabelingo, its owners, employees and contractors, from and against any claim, demand, action, damage, cost, liability or expense (including reasonable legal fees) arising from or related to (i) your breach of these Terms, (ii) your misuse of the Service, (iii) your violation of any law or third-party right, or (iv) any dietary, medical, religious or food-safety harm you or any third party allege in connection with food ordered, prepared or consumed with the assistance of the Service.
13. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles.
Except where mandatory consumer protection law of your country of habitual residence provides otherwise, any dispute arising out of or in connection with these Terms or the Service will be submitted to the exclusive jurisdiction of the courts of the Comarca de São Paulo, State of São Paulo, Brazil.
If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you the non-waivable right to bring proceedings in your local courts, that right is not affected by this Section. The European Commission's online dispute resolution platform is available at https://ec.europa.eu/consumers/odr/.
14. Force majeure
We are not liable for any delay in or failure of performance arising from any cause beyond our reasonable control, including without limitation natural disasters, acts of government or regulators, war, terrorism, civil unrest, epidemic or pandemic, labour disputes, or failure of third-party infrastructure, telecommunications or payment systems.
15. Assignment
You may not assign or transfer these Terms, in whole or in part, without our prior written consent. We may assign these Terms, in whole or in part, to any affiliate or to any successor to our business, upon notice within the app.
16. Changes to these Terms
We may update these Terms from time to time. The current version is always available inside the app and at our published URL. Where a change materially affects your rights or obligations, we will notify you inside the app before it takes effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the updated Terms.
17. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will remain in full force and effect.
18. No waiver
Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or of any other provision.
19. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us with respect to the Service and supersede all prior or contemporaneous communications, agreements and proposals, whether oral or written.
